Terms of Service

1. Acceptance

By downloading, installing, or using schirleMix ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.

2. The Service

schirleMix is a color mixing recipe tool for oil painters. It provides paint mixing recipes, image color analysis, image filters, and AI-powered features (AI recipes, palette advisor, and AI mentor chat).

Core features (color picking, recipe generation, image filters, palette building) work offline. AI-powered features require an internet connection and consume credits.

3. Accounts

You can use core features without an account. To access AI features, you must sign in with Google or Apple. You are responsible for maintaining the security of your account. One account per person.

4. AI Credits

AI features cost 1 credit per use. Painting critiques (which include an image) cost 5 credits. New accounts receive 25 free credits. Additional credits can be purchased in-app. Credits are non-transferable and non-refundable. We reserve the right to change credit pricing at any time; existing purchased credits will not be affected.

5. Desktop License

The macOS and Windows versions require a one-time license purchase ($9.99). Each license can be activated on up to 3 machines. You can deactivate a machine to free a slot. License keys are non-transferable. We may revoke a license if it is shared publicly or used in violation of these terms.

6. Mobile Purchases

iOS and Android purchases are handled through the Apple App Store and Google Play Store respectively. Those purchases are subject to the terms of the respective store. Refund requests for mobile purchases should be directed to Apple or Google.

7. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or disassemble the App
• Attempt to bypass credit requirements or license activation
• Use automated tools to make bulk API requests
• Share your license key publicly
• Use the AI features to generate harmful, illegal, or abusive content
• Resell or redistribute the App

8. AI Features Disclaimer

AI-powered features (AI recipes, palette advisor, AI mentor) are provided by third-party AI models. Responses are generated and may be inaccurate. AI suggestions are artistic guidance, not guarantees. You are responsible for your own mixing decisions. We do not guarantee the availability, accuracy, or consistency of AI features.

9. Intellectual Property

The App, its code, design, and content are owned by schirleMix. Paint data (names, pigment codes) is used for informational purposes. Your images, palettes, notes, and other content you create remain yours — we do not claim any rights to your content.

10. Limitation of Liability

The App is provided "as is" without warranties of any kind, express or implied. We are not liable for any damages arising from your use of the App, including but not limited to inaccurate mixing recipes, wasted paint, or lost data. Our total liability is limited to the amount you paid for the App.

11. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time by emailing schirlemix@gmail.com. Upon termination, your credit balance and license activations are forfeited.

12. Changes

We may update these terms from time to time. The "last updated" date at the top will reflect any changes. Continued use of the App after changes constitutes acceptance of the updated terms.
